FAMILIES LOOKING FOR A NANNY OR
MOTHER’S/PARENT’S HELP
These Terms and Conditions of Business shall represent a legally-
binding contract between Honey Nanny Recruitment Agency LTD
and the Client{or Employer}

AGENCY OBLIGATIONS:

 1.A submitted Registration Family Form [Nanny and Mother’s/Parent’s help]
is essential on placement of order. The  placement of order will be deemed
acceptance of these Terms of Business and agreement to pay the
administration charge and the Agency Introductury Fees as appropriate.

 2.The Agency operates only as an Introduction Agency only between
Clients and Applicants.The final decision for employing an Applicant is
Client’s.

 3.The Agency will make every endeavor to introduce only high calibre,checked and reliable Applicants,as much as possible suited to your needs.At the same time the Agency does not provide any warranty concerning history, character, capability or suitability of any Applicant.

 4. The Agency does not employ Applicants directly or indirectly.
The Agency can not be responsible for any damage, loss or expense incurred
either directly or indirectly by reason of the negligence or shortcomings of any Applicant engaged by the Client.

   5. The Agency will refund the Fee after deducting of 30 pounds Administration Charge if an Applicant fails to take up the engagement after agreeing to do so.

 6. The Agency offers  4 weeks, 28 days Probationary period, starting with the employee’s date of commencement .If the employee have proved unsuitable within that period a Free replacement will be offered.
In the event that no suitable replacement is available, the Agency will provide the following refunds:

If the Applicant leaves after the first week:
Free replacement or 80%
If the Applicant leaves after the second week:
Free replacement or 60%
If the Applicant leaves after the third week:
Free replacement or 40%
If the Applicant leaves after the fourth week:
Free replacement or 20%

 7. Refunds will not be given if the employee has left as a result of unreasonable conditions or conditions completely different from the contract.

 8. The Probation period and Refund guarantee apply only for long term positions, 12months or more.

 9. No Replacement guarantee or Refund will apply if the Client has been in breach of any of the Agency’s Terms and Conditions.

 10.The Agency reserves the right to add interest to outstanding accounts in the amount of 10% above the Bank of England base rate of interest for each week that the Invoice remains unpaid.

 12.All payments must be in UK pounds, unless otherwise agreed in writing.
We accept cheques and postal orders payable to Honey Nanny Recruitment LTD.

 13.If any cheque from the Client is returned by the Bank as unpaid for any reason, the Client will be eligible for an additional Administration Fee of 30 pounds.

 14.The Agency reserves the right to add a 10% surcharge to all Fees not paid
within 28 days of the Agency invoice .Should any or all monies not be paid
from the Client within this timescale, then the Agency reserves the right to refer the outstanding debt to a debt collection Agency.

 15.The Agency will treat all your information as a Strictly confidential and will not pass it to anyone.

CLIENT’S RESPONSIBILITIES:

  1.The Client shall represent wish to find a suitable  Child carer by registering and filling the Registration Form with all enquires about the Applicant and shall provide the Agency with as much as clear information about the family lifestyle and children’s needs.

  2.The Client shall be responsible for checking all relevant Applicant’s
documentation and for the final decision of the engagement.

  3.It is the Client’s responsibility for the prospective Employee’s reasonable traveling expenses for the purpose of interview and this to be
settled with the individual.

  4.The Client agrees to notify the Agency immediately in writing of the Applicant’s acceptance of  the employment. At all times after the
the engagement  has been made, the Applicant is under Client’s supervision.

  5.The Client will pay the Placement fee on acceptance, either verbally or in writing and not at the commencement of the employment. The \
Client shall be liable to pay the Agency’s Placement fee at rates shown in the current scale of charges within 10 days
shall be liable to pay the Agency’s Placement fee at  rates shown in the current scale of charges. within 10 days of the date of the Invoice.
If the settlement is not received within that period ,the Replacement or Refund guarantee shall not apply.

   6.The Fee charged for a Placement is applicable to one engagement only. If the Client engage an Employee within 12months of Termination
of Employment a Further fee will be charged and the Agency must be notified immediately of any such arrangement.

  7.The Client will notify the Agency if a temporary Employee continues after the contract term and Additional fee then will be charged up to 12
weeks. Thereafter the Fee for a permanent engagement will be payable.

 8.The Client shall be responsible for obtaining work permits and the Agency does not accept any responsibility if such a permit can not be
obtained or the proper visa.

 9. The Client is responsible for the Employee’s contract paying National insurance and Tax deductions.This must be arranged between the Client and Employee. The salary must be negotiated between the Client and the Employee.

Please, note that not declaring to be an Employer is a criminal offence, which can result in heavy penalties!

 10.All information and introductions supplied by the Agency are confidential .Should a Client pass any information to a Third Party,
resulting in permanent, temporary or part- time employment, the Client shall be responsible for the full Placement fees.

 11.In the event that an engagement is offered and is canceled by the Client prior the employment, a Fee of 100 pounds is chargeable to the Agency.

THE AGENCY RESERVES THE RIGHT TO CHANGE THESE TERMS AND CONDITIONS OF BUSINESS WITHOUT A PRIOR NOTIFICATION.

THESE TERMS ARE GOVERNED BY THE LAW OF ENGLAND
AND WALES AND ARE SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE COURTS OF ENGLAND AND WALES.

AN AU-PAIR

These Terms and Conditions of Business shall in all respects apply to all contracts or agreements made between Honey Nanny Recruitment Agency
LTD and the Client {Employer}

AGENCY OBLIGATIONS:

 1.The Agency shall register the Client upon a receipt of a fully completed and submitted Family Registration Form[AU-Pair]

 2.Upon registration of the Client, the Agency agrees to provide the Client with Applicants, suited as much as possible and all relevant information and documentation.

 3.The Agency   introduces to the Client only thoroughly checked Applicants. However the final decision for employing the Applicant rests with the Client, who is therefore strongly advised to check details, references and all documentation personally.

 4.The Agency does not employ the Applicants and operates only as an Introduction Agency between Clients and Applicants.

 5.The Agency will make arrangements for placement after the Client has made final decision and send the Placement fee.

 6.The Agency can not provide any warranty as to suitability, character or capability of any Applicant.

 7.All correspondence and records shall be strictly confidential and remain the property of the Agency. Information supplied by the Agency is confidential and is accepted by the Client on the condition that such information will not be disclosed to a Third party.

 8.The Agency accepts no liability of any inconvenience, loss or damage of property, or any loss or injury however arising directly or indirectly from any act or omission of any Applicant introduced by the Agency, even if such an act or omission is negligent or fraudulent or reveals dishonesty.

 9.The Agency reserves the right to add interest to outstanding accounts in the amount of 10% above the Bank of England base rate of interest for each week that Invoice remains unpaid.

 10.The Agency reserves the right to add a 10% surcharge to all Fees not paid within 28 days of the Agency invoice. Should any or all monies not be  paid from a Client within this timescale then the Agency reserves the right to refer the outstanding debt to a debt collection Agency.

 13.The Agency strongly recommends that Au-Pairs should not be left in sole charge of young children, under 2years old, for long periods, as they are not trained Child carers.

 14.The Agency offers 4 weeks, 28 days, Probationary period, starting with the Au-Pair’s commencement of engagement. The mentioned above Probationary period applies only for a long term positions[12months or more]
 
 15.In the event of an Au-Pair introduced by the Agency and engaged by the Client, has proved unsuitable during the 28 days Probationary period ,the Client must notify the Agency during the trial period in writing stating the reasons for unsuitability and return the Au-Pair to the Agency for replacement.

 16.In the event of unsuitability, during the mentioned above 28 days Trial period and provided written notification and the Agency has received on or before the date of commencement the Placement Fee in full,
the Agency will refund 50% of the Placement Fee or supply a replacement Au-Pair, whichever the Agency shall in its discretion think fit.

 17. Upon expiry of the Probationary period, 28 days, it is agreed that the
Engagement is satisfactory and that the Agency’s obligations have
been fulfilled.

 18.In the event of the Agency being unable to place the Au-Pair with the Client, then the Agency will supply an alternative Au-Pair or refund of the Placement Fee, whichever the Agency shall in it’s discretion fit.

 19. In the event that the Applicant introduced by the Agency is dismissed by the Client or leaves of his/her own accord within the Probationary period, the Agency must be notified immediately. The Agency will endeavour to find a FREE replacement as quickly as possible.

Only One replacement is allowed!

If the Client doesn’t require a replacement or makes own arrangements, NO refund can be given.

 20.The Agency cannot guarantee that the Applicant will complete her or his proposed length of stay or engagement. The Applicant is free to
leave, if feels unhappy or circumstances make it impossible to stay.

 21. In the event that the Applicant should cancel an agreed engagement prior to the commencement, the Agency will make a full Refund after
deducting the current Administration charge of 30 UK pounds.

CLIENT’S OBLIGATIONS:

 1. The written instruction [Family Registration form] of the Agency by the Client to submit suitable Applicants for a contract or interview,
shall constitute acceptance of the Agency’s Terms and Conditions of Business.

 2. Should a Client effect any form of introduction, direct or indirect of an Applicant to a Third Party, or pass on any details resulting in
permanent, temporary or part-time employment, the Client will be responsible for the Full Placement fees. 

 3. The Client agrees to notify the Agency immediately upon an engagement has been accepted by an Applicant and to supply details
to the Agency of the date of commencement and length of engagement and wages.

 4. Should a short-term engagement be extended by the Client or any Applicant be re-arranged at any future time, the appropriate Additional
fee shall become payable .The Agency must be notified immediately of any such changes.

 5 .In the event that a Client cancels an agreed engagement prior to the commencement date, 50% of the Placement fee will be payable and
the Agency will not be able to seek other Applicants until the fee has been paid.

 6.  Fees are due on acceptance, either verbally or in writing, and not at the commencement of employment. The Client shall be liable to pay
the Agency’s Placement fee at the rates in the current scale of charges within 10 days of the date of the Agency invoice. If settlement
is not received within that period, the Replacement or Refund Guarantee shall not apply.

 7. The Agency reserves the right to add interest to outstanding accounts in the amount of 10% above the Bank of England base rate of interest for each week that the Invoice remains unpaid.

 8. No Replacement guarantee or Refund will apply if the Client has been in breach of any of the Agency’s Terms and Conditions.
